SC vacates its interim order regarding NTA

December 27: Nepal Telecommunication Authority can now issue license to individuals and companies to construct towers and other infrastructures. This has been possible after the Supreme Court on Tuesday (December 26) vacated an interim order issued to the NTA earlier not to grant license to individuals and companies for construction works.

A joint bench of Chief Justice Gopal Parajuli and Justice Deepak Raj Joshi on Tuesday quashed the interim order that barred the state-owned utility outsourcing the contract works.

NTA had issued a tender on November 3 calling for bids to construct towers at various places. The notice had set various terms and conditions.

Nisesh Mishra of Lalitpur had filed a writ petition at the apex court stating that the terms and conditions set by the NTA were against the constitution and the Infrastructure Regulations 2074. Initially, the SC had issued an interim order to the NTA not to carry out construction works. But on Tuesday, the SC ruled that the notice issued by the NTA was not against the constitution and subsequently lifted the interim order.
