January 9: The Supreme Court on January 8 removed Lok Man Singh Karki from the post of Chief Commissioner of the Commission of the Investigation of Abuse of Authority (CIAA).

In response to a writ petition filed by advocate Om Prakash Aryal on November 25, 2015, a full bench of Justices Ishwor Prasad Khatiwada, Ananda Mohan Bhattarai and Anil Kumar Sinha yesterday issued a verdict that Karki did not meet the qualifications to lead the anti-graft constitutional body.

Aryal in his writ petition had argued that Karki did not hold the required qualifications to head the CIAA. The court in its verdict stated that Karki’s appointment as CIAA chief does not meet the requirement of Articles 119.5c and 119.5e mentioned in the Constitution.

A division bench of Justices Gopal Parajuli and Om Prakash Mishra, however, quashed the writ petition filed by advocate Aryal on September 24, 2014.

Later, a division bench of Chief Justice Sushila Karki, Justices Bishwambhar Prasad Shrestha and Sapana Pradhan Malla, on September 16, 2016 had revisited the writ and found that there was an error in the earlier verdict.

Meanwhile, the apex court slapped a fine of Rs 1,000 on Karki's son-in-law Prabal Thapa for obstructing the court officials to paste the summons notice at Karki’s house in New Baneshwor.

The court also issued a mandamus order to the Constitutional Council and President’s Office to appoint a qualified person as the Chief Commissioner of CIAA.

The then Chief Justice Khil Raj Regmi-led interim council had appointed Karki to the top post of CIAA.
