May 31: Absence of collective trademark for Nepali production has hampered export promotion of domestic products. “Products with collective trademark carry national identity enhancing the potentiality of exports,” says Bimal Nepal, Executive Director of Trade and Export Promotion Centre adding, “Collective Trademark also raises credibility of the product.”

Products having comparative advantages included in Nepal Trade Integration Strategy (NTIS) still do not have collective trademark. According to the Centre, although the government has included nine various agricultural and industrial products with potentiality of export and high competitive capacity in NTIS, only two products Pashmina and Tea have received collective trademark so far.

As per the centre, Cardamom is a product which is in process of obtaining trade mark. It informs that department of industry has already provided first phase of certificate for collective trademark of cardamom to Nepal Cardamom Traders Association. Along with the registration in Nepal, the centre has provided budget to register the collective trademark in India, UAE and Pakistan.

Nevertheless, the collective trademark of tea has been registered in Nepal only.

Although, the collective trademark of Pashmina has been registered in India, America, Australia, China, EU and nearly other 43 countries, informs Nepal Pashmina Industries Association (NPIA). In the meanwhile, collective trademark of carpet could not be registered due to conflict between Nepal Carpet Exporters Association (NCEA) and Central Carpet Industries Association (CCIA). Even though, in the recently published three months task plan of Commerce Ministry, it has mentioned of concluding registration of carpet trade mark in America and Europe within the current FY.

On the contrary, no initiation has been shown in order to register collective trademark of other products included in NTIS. Cardamom, Tea, Pashmina, Carpet, Ginger, Herbs, Fabricated Textiles/Yarns, Shoes and Sandals are some of the products included in NTIS. The government has announced these products as comparative advantages products though it have not registered collective trademark for them.

“Collective Trade Mark facilitates in legal solution if any problem arises” says Anup Bahadur Malla, Chairman of Export Promotion Committee of Federation of Nepalese Chamber of Commerce and Industries adding the context of Nepalese Carpet being duplicated and exported by India.
